50 Shades of Real Estate Love, Passion and Obsession

In a weekend when Valentine’s Day love collides with 50 Shades of Grey obsession, you can’t help but ponder other loves, passions and obsessions that warrant celebrating. From an early age I have nurtured an unshakable love for Real Estate. Discovering how real estate creates that special type of shelter that everyone yearns to possess; it evens generates the brand of wealth that most cannot amass by simply working a job; and it gives great power to its owners who are fortunate enough to hold on to it at the right time and wise enough to let go when necessary.

I cherish the pure and innocent love of real estate inherent in every first time home buyer who asks me to help them acquire their first home. I sense their determination as they formulate plans to own their very first piece of the earth. I cheer them on as they save every penny, cut out the Starbucks coffee, eat tuna sandwiches for months and adopt other austerity measures until they secure the minimum 3.5% down-payment to qualify for an FHA loan. I celebrate with them when they close escrow, get their first set of keys and step over the threshold for the first time as homeowners.


I recognize that mature love for real estate in the family that has outgrown their starter home because their family has expanded beyond that town-home and they yearn for a single family home with a beautiful yard for their kids to play and located in a great school district. They are thrilled to discover that they have amassed substantial equity which will provide huge down-payment for their move-up home.

I tip my hat to the entrepreneurial passion (sometimes obsession) for real estate unique to investors, flippers, budding landlords who seek out diamonds in the rough and develop them into profitable ventures. These rare breeds spend countless hours at court house auctions, show up at bankruptcy sales, probate sales, scout out every fixer upper on the MLS, and even knock on doors of delinquent property tax homeowners. They endure many indignities, yet, they do not lose their focus on the gainful outcome. We all owe these flippers and investors a debt of gratitude for improving our neighborhoods with their cash infusion in previously dilapidated properties.

I am most touched by the elderly with foresight in the power of real estate to provide them with a safe and secure retirement. Their sage wisdom will earn them many dividends as they liquidate and swap their vast landed estates for smaller manageable condominiums in retirement or other fun communities.

Los Angeles County Homeowners – It is Time to Appeal Your Property Tax Assessment

In Los Angeles County, your property tax is based on LA County Tax Assessor’s determination of your property value.  As a homeowner, you have an opportunity to challenge your assessed property value between June 1 and November 30 of the current year.  Now, is that time of the year to challenge LA County Tax Assessor’s value of your home and reduce your property tax.  I encourage you to review your property tax value to determine if your property is being assessed a higher value than necessary. 

 

 

On the average, your property tax will the assessed value multiplied by 0.0125.  Thus, if your property is valued by the Tax Assessor at $700,000, your annual property tax will be approximately $700,000 x 0.0125 = $8,750.  However, if you can find 2 comparables that sold between January 1 and March 31 of the current year that support a value less than $700,000 (e.g. $500,000), then your property tax will be $500,000 x 0.0125 = $6,250.  This example realizes a $2,500 savings for the current year.

To challenge LA County Tax Assessor’s value of your home, you should complete the below 2 Forms, attach 2 comparables that sold between January 1 and March 31 of the current year, and file the completed Forms.  You can obtain comparables from your Realtor.  You must file the Forms between June 1 and November 30 of the current year.

“Greatest Failure” versus “Respect for Homeowner’s Privacy” – You Decide!

For its June 2013 Challenge, Active Rain asks us (its members) to write about our “Greatest Failure” in exchange for  500 reward points.  At first blush, it seemed no amount of points would ever tempt me to publish an article titled “My Greatest Failure”.  Upon further reflection, I felt comfortable (even inspired) to write about why I had not embraced nor fully implemented one of real estate industry’s most popular marketing strategies “door-Knocking”.

“Door-Knocking” is a real estate industry practice where real estate agents and brokers carve out a specific “farm” of properties (about 200 to 500 homes) and on a periodic basis (usually, once per month) show up (un-invited) at each property, knock on the door and proceed to market their real estate services to the homeowner.  Many in our industry have found this practice to be exceptionally rewarding and have built significant wealth around spoils from this form of marketing.  Clearly, “door-knocking” requires a lot of the same skills that make sales people successful – intestinal fortitude, persistence, endurance, ability to quickly disarm hostile homeowners who resent putting up with uninvited sales professionals.

I have refrained from this industry practice of “door-knocking” for many reasons starting with the homeowner’s right to privacy.  While my top reason for refusing to “door-knock” is to respect personal privacy in one’s home; in business (as in life), I generally avoid the indignity of being kicked out of places I have not been invited.  I also avoid being attacked by vicious dogs and gun-wielding hostile homeowners.   I firmly believe that the home-owner’s right to privacy trumps any need to market my services in such an invasive manner especially when there are less invasive (and arguable just as effective) marketing alternatives to implement.

No doubt, door-knocking spans many professions and it is probably as old as the history of sales.  However, I know how irritated and violated I feel when I am in my PJs and have not groomed for the public, and yet an uninvited person (other than the mail-delivery person, the FedEx delivery person, etc.) shows up to market their wares.  And yes, the worst offenders are real estate sales professionals and religious invaders.  Understandably, I empathized with Michael Caine and Robert Duvall in the movie “Secondhand Lions” as they shot their double-barrel guns at every uninvited sales person that showed up on their land.

So you be the judge – does the need to market our real estate services trump the home-owner’s right to not have uninvited strangers knock on their door when the homeowner has not showered nor brushed his teeth, may be sleeping, children may be napping, infirmed or insomniacs may be enjoying limited precious sleep, or simply do not want to be bothered – especially when there are less intrusive alternatives such as sending the marketing material in the mail combined with a compelling internet presence?

Given above choices (and my personal and business sensibilities), I will always chose to “put a stamp on it”, respect the homeowner’s privacy and cop to the “greatest failure” of not “door-knocking”.

(1)    You Get Rid of an Under-Water House and Get Rid of Your Crippling Mortgage Debt: If you owe more on your house than your house is currently worth, you should consider a short sale.  Even if you have multiple mortgages on your home, a successful short sale in California allows you to sell your home and the remaining mortgage debt is wiped out.  California law currently states that as long as your mortgage lenders agree to the short sale, the remaining mortgage loan balance is wiped out and uncollectable.  In contrast, a foreclosure may still leave you personally liable for a large portion of the mortgage debt on a recourse loan even after the foreclosure is completed.  Because a successful California short sale gets rid of the entire mortgage debt, it is always a prudent option to explore before letting your home go to foreclosure.

(2)    Your Relocation Allowance could be Substantial: Many mortgage servicers now offer significant financial incentives in the form of Relocation Assistance to home owners who opt to short sell their homes.  Typical relocation assistance offered by mortgage servicers to home-owners can range from $2500 to $45,000. Mortgage servicers are able to offer these substantial relocation allowances to home-owners because mortgage servicers averagely net 25% less proceeds in a foreclosure than in a short sale.

(3)    You can Avoid Property Tax and Routine Maintenance Expenses:  By short selling your under-water home, you can avoid paying property tax and routine maintenance expenses, such as gardener, utilities, repairs, as soon as the home is sold.

(4)    You Enjoy a Dignified Exit instead of an Oppressive Foreclosure: Unlike a foreclosure, a short sale allows you to hire a real estate professional of your choice who lists and markets your home for sale and negotiates the short sale with your mortgage servicer.  You control the transaction and the public information disseminated about the sale of your home because the real estate professional works for you. In a short sale, you can also choose to have your home marketed and shown at your convenience.   In contrast, a foreclosure can be very traumatic and oppressive.  In a foreclosure, your default is publicly recorded via a Notice of Default and the foreclosure sale is also publicized via a Notice of Sale.  A very public notice is posted on your front door stating that you are in default on your mortgage and this can be read by your neighbors right before your home is auctioned off publicly.  When going through financial distress, it is definitely beneficial to explore a private and dignified short sale before letting the house go to public foreclosure.

(5)    You Enjoy Shorter Credit Repair and You Can Buy Your Next Home Faster:  When you sell your home in a short sale, it usually takes an average of 2 years to rehabilitate your credit and be in a position to get a new mortgage loan to buy your next home.  However, if your home is foreclosed, it could take anywhere from 4 to 7 years before you can get a new mortgage to buy a new home.  The impact of a short sale on your credit report rating is much less devastating than a foreclosure.  For instance, the missed payments leading up to a short sale may cost you about 50 points in your credit rating; in contrast, a foreclosure could cost you over 300 points and the foreclosure will remain on your credit report for 7 or more years.

In sum, if your home is upside-down, and you are experiencing some financial distress and you need relief from the mortgage debt, a short sale allows you to sell your home, get rid of the mortgage debt and deficiency, maybe even score some Relocation Assistance from $2500 to $45,000, and enjoy the “New Beginning” that you so rightly deserve.

Malibu Historic Real Estate – The Adamson House

After successfully closing a very complex short sale transaction wrought with numerous legal matters including seller bankruptcy and buyer litigation, I was quite eager to celebrate my continuing 100% closing record on short sales and revisit and renew my passion for selling beautiful real estate – A visit to the Adamson House certainly did the job!

The Adamson House is located on the Malibu coast, adjacent to Surfrider Beach, Malibu Lagoon, and Bird Sanctuary.  It is on the National Register of Historic Places and designated as a California Landmark. This beautiful  Spanish Colonial style Malibu home was built in 1930 by architect Stiles O. Clements and commissioned by Mrs. Adamson, the daughter of Frederick and May Ridge, the last owners of the Malibu Spanish land grant.

What’s most inspiring and fascinating about this home is the perseverance and ingenuity of its female owners who fought crushing tax liens, threats of eminent domain takings, and devastating financial crisis to keep this home in the family.  In fact, the unique ceramic tile-work that now pervades the house and has earned the Adamson House a place in the National Register of Historic Places was one of Mrs. Adamson’s creative projects to generate financing for the Adamson House. 

The determination and passion of these Adamson women to keep their home echo the urging of Scarlet O’Hara’s father in Gone With The Winds: “home is the most important thing in the world, man will fight and die for it.”
